TERMS AND CONDITIONS Last Updated: December 2, 2025 

  1. Introduction Welcome to Jubilations.com (the "Site"), owned and operated by Jubilations Bakery ("we," "us," or "our"). By accessing or using our Site, placing an order, or joining our VIP Club, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to all of these Terms, please do not use this Site.
  2. Use of the Site & Eligibility
  • Age Requirement: You must be at least 18 years old to place orders or join our clubs. By using this Site, you represent and warrant that you meet this age requirement. 
  • License: We grant you a limited, non-exclusive, non-transferable license to access and use the Site for your own personal, non-commercial use. 
  • Prohibitions: You agree not to copy, reproduce, scrape, or distribute any content from our Site without our express written permission. You agree not to use the Site for any illegal purpose or to submit false or fraudulent orders. 
  1. User Submitted Content (Recipes & Ideas) We love hearing from our community! If you submit recipes, flavor ideas, photographs, reviews, or other content ("User Content") to us (for example, through our "Recipe Swap", social media, or email):
  • Grant of Rights: You grant Jubilations Bakery a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content throughout the world in any media. This includes the right to create, name, and sell new products based on your ideas without any compensation to you. 
  • Representation: You represent and warrant that you own or otherwise control all of the rights to the User Content that you submit and that the content is accurate and does not violate these Terms. 
  • Community Voting & Selection: While we may conduct community votes to gauge interest in potential new flavors (e.g., "VIP Recipe of the Month"), Jubilations Bakery retains sole discretion over which products to produce. Winning a community vote does not guarantee that a recipe will be manufactured or sold. We reserve the right to modify any submitted recipe for production feasibility. 
  1. VIP CLUB PROGRAM Membership Eligibility: Membership in the Jubilations VIP Club is free and open only to residents of the United States (excluding U.S. Territories and international locations) who are at least 18 years of age. Member Benefits:
  • 5% Member Discount: You must be logged into your account to receive the automatic 5% discount. This discount applies to eligible items and may be combined with other offers or coupons unless explicitly stated otherwise in a specific promotion. 
  • Monthly Sweepstakes: Active members are eligible for our Monthly Cheesecake Drawing. Prizes will only be shipped to street addresses within the contiguous United States. Participation is subject to the Official Sweepstakes Rules [Link], which govern all aspects of the drawing. 
  • Exclusive Offers: From time to time, we may provide members with special digital surprises, such as birthday perks or promo codes. These offers are subject to change and availability. 
  • Cancellation: You may cancel your membership at any time by contacting cheesecakes@jubilations.com. Upon cancellation, you forfeit all VIP benefits. 
  1. Product Availability, Pricing & Quantities
  • Errors: We strive for accuracy, but errors may occur. We reserve the right to correct any errors in pricing or descriptions and to cancel or refuse any order placed at an incorrect price, even after the order has been confirmed. 
  • Right to Limit Quantities: We reserve the right to limit the quantity of items purchased per person, per household, or per order. We may, in our sole discretion, limit or cancel orders that appear to be placed by dealers, resellers, or distributors. 
  1. Shipping & Perishable Goods Policy
  • Geographic Restrictions: We currently ship only to street addresses within the contiguous United States. We are unable to ship to P.O. Boxes, APO/FPO addresses, international locations, or to Alaska and Hawaii due to the perishable nature of our products. Orders placed for restricted locations will be cancelled and refunded. 
  • Perishable & Frozen Nature: Our cheesecakes are shipped frozen to maintain quality. Because our products are perishable, it is the purchaser’s responsibility to ensure that the recipient is available to receive the package on the delivery date. 
  • Liability: We are not responsible for packages that spoil or are damaged because they were left unattended after delivery, refused by the recipient, or because of an incorrect address provided by the customer. 
  1. Allergen Warning PLEASE BE AWARE: Our bakery produces items that contain or may come into contact with common allergens, including WHEAT, EGGS, MILK, SOY, PEANUTS, AND TREE NUTS. While we take precautions to minimize cross-contamination, we cannot guarantee that any product is completely free of allergens. Customers with severe allergies should exercise caution.
  2. Intellectual Property All content included on this Site, such as text, graphics, logos, images, audio clips, and software, is the property of Jubilations Bakery or its content suppliers and is protected by United States and international copyright laws.
  3. DISCLAIMER OF WARRANTIES THE SITE AND ALL PRODUCTS AND SERVICES MADE AVAILABLE THROUGH THE SITE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
  4. LIMITATION OF LIABILITY TO THE FULLEST EXTENT PERMITTED BY LAW, JUBILATIONS BAKERY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES RESULTING FROM THE USE OR THE INABILITY TO USE THE SITE OR PRODUCTS PURCHASED, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, DATA, OR OTHER INTANGIBLES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
  5. Indemnification You agree to indemnify, defend, and hold harmless Jubilations Bakery, its officers, directors, employees, agents, and suppliers from and against all losses, expenses, damages, and costs, including reasonable attorneys' fees, resulting from any violation of these Terms or any activity related to your account (including negligent or wrongful conduct) by you.
  6. Governing Law These Terms shall be governed and construed in accordance with the laws of the State of Mississippi, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be resolved exclusively by the state and federal courts located in Mississippi.
